What can I do about an old septic tank that encroaches on the neighbor's property?

If the septic tank ever crosses the border into your neighbor's property you will be required to relocate it and pay your neighbor for any damage done to his property in the process. Your best bet is to dig it up and relocate it as soon as possible to avoid legal problems.

You could get a legal document saying that agree to allow it to remain maybe that they are even leasing you rights to allow it there, but that would require your neighbors to go along with it. I doubt that is going to happen. You will have to remove it.

If a neighbor's yard must be disturbed in order to properly remove or service a septic tank, you can often request an easement to access the tank via the property.

You can discuss with the owner moving the property line a small amount to include the tank. You can ask for an exemption or abatement to allow the septic tank. You can dig up the tank and have it removed or simply moved a short distance. You can discuss compensating them for the encroachment.

If you leave it long enough and the neighbor says nothing, you may gain legal rights through adverse possession. The time varies by State but is usually a few years.

The septic tank will need to be relocated. The faster you can get this done the less legal hassles. You will need to pay any costs related to the move.
