What should I do if I am being harassed by the plaintiff's attorney?

If you are represented by counsel, they should not even be talking to you without your lawyer present, and you should bring this up with your lawyer. If you do not have a lawyer, they should really only be telling you to get one. Harassing an adverse party is unethical, and you or your lawyer should notify the judge.

The plaintiff's attorney has the right to contact witnesses for the defendant. You are not required to speak to the plaintiff's counsel. Harassment means that this contact constitutes a real threat to your safety or that it is offensive. Harassment is a crime, and if you feel this contact constitutes harassment, report it to the police.

Alert your attorney right away. He will do what needs to be done in order to take care of the harassment.

If you are represented by an attorney tell the plaintiff's attorney you are represented by a lawyer. Ethically a lawyer may not initiate communication with a represented person.

You can get a restraining order against the attorney or, if you are sure the attorney is clearly in the wrong, you can file complaint with the state bar. This is assuming the attorney is harassing outside of the courtroom. If you are talking about harassment inside the courtroom, the judge is the authority to handle it.

If you have an attorney of your own then you need to report the behavior to your attorney and they can then take the appropriate action. If you do not have an attorney then study make sure what they are doing is harassment. If so then you will need totalk to the judge yourself.
