In pure comparative fault, you can recover in lawsuit in which you were negligent, even if you were 99% at fault and the other party 1%. But in non-pure comparative fault, you cannot be more than 50% at fault and still recover.

Non-pure comparative fault you cannot recover in a negligence action. No matter how much you have. Example is if you were 50% fault you can still sue for 100% fault.

It's a legal doctrine typically applicable in civil lawsuits requiring plaintiffs to prove that a defendant's conduct was more responsible for causing particular claimed harm than a plaintiff's conduct was.

When there is negligent action, you can only recover in a suit if you are 49 percent or less at fault. If you are 51% at fault, you are not able to take action.

Non-pure comparative fault means that a person can be partially at fault and still recover. In other words, both parties cannot be equally at fault.
