The degrees of theft have to do with the seriousness of the crime as well as the range of penalties assigned to it. The definition varies from state to state. The state laws are probably posted online. Do a search for "third degree theft of property" AND [state]. The search will bring up a link to the law.

Theft in the third degree includes property or services with a value of less than $250. Most common examples would include shoplifting or passing checkes without funds to cover them.
