If someone gets a garnishment against you the employer has to comply by law. The money will be taken out of your check and sent directly to the creditor.

You will have to have been sued in small claims, circuit or family court and the judge will have to give a court order for your wages to be garnished. A court offical will supply the necessary documentation to your employer and they will automatically divert part of your wages to your creditor.

A creditor may file an action against a debtor in order to recover. The case will be heard and in more cases, the court file a judgment against the debtor. The creditor can then request permission to attach wages, assets and personal and real property. You may have an opportunity to demonstrate hardship to avoid garnishment.

Child support is the only thing that your employer can garnish from your wages without permission. Otherwise they have to have WRITTEN consent from you in order to take any money from your check for various purposes. For example if you owed them money they can't just take it from your check.

The garnishing wages in Louisiana are different from some other states. Louisiana has no minimum wage law that can be paid. The amount that is withheld is going to be 25 percent.
