My neighbor's tree fell on my house. How do I make him pay for the damage?

Start with your home owner's insurance. They will go after him and/or his insurance. Otherwise, you will need to file in small claims court, depending on the amount.

First, you should try to talk to your neighbor and find out if his homeowners insurance will cover it or did he want to pay you directly for the damage himself. As a last resort, you can file in small claims court against him for the damage.

You will need to prove that your neighbor knew that his tree was a risk to your property which would them make his responsible for the cost due to negligence and a judge would then order him to pay for it.
