Is it okay for a landlord to hold an open house to sell the house while we are renting it?

I want him to wait until we are gone but he is anxious to sell.

The landlord has the right to have an open house in an effort to sell the property, even though you are renting. Although your state's tenant landlord rules may be more specific, he should give you at least 24 hours notice so that you can prepare and arrange to leave the house, which is customary. You cannot impede his efforts.

Absolutely it is ok of him to do something like this. Check out your rental agreement and it probably stipulates that they can do something like this. Speak with him too.

Unless the two of you reached an agreement to allow the showings while you are still a legal tenant, then he should wait until you have vacated. I would agree to it to increase the chances of you receiving your deposit back.

The landlord and tenant should both be considerate of each others rights. If the landlord wants an open house, then tenant and landlord should set some guidelines for this.

Whether or not your landlord can hold an open house to sell while you are still renting it depends on what your lease says. Your landlord probably included a statement that says he can list the property for sale, to include holding open houses, while it is being rented and you are living in it.

You as a renter have no control over when the land lord wants to sale the house it is his. But you should ask a lawyer to know for sure.
