Report your boss to the Labor Board immediately. Withholding pay is against the law. Your boss is trying to avoid payroll checks bouncing, which is not your problem, and you should not suffer as a result. In the meantime, look for a new job.

It is not legal for your boss to hold onto your check, assuming that you earned the payment. Get another job as soon as you can.

I would check on your states labor laws. I believe it would be illegal. There should also be a written company policy that you can refer to on this matter.

If it states in the employment contract that you are paid every other Friday, than no it is not legal. If that is not clearly states in an employment contract you need to get it in writing. After that if they hold it again, contact the State Labor Commission.

If he has processed payroll and has a check, it is not legal to deliberately withhold the paper check. If he does this repeatedly, switch to direct deposit.
