How do you trademark or copyright your name on MySpace?

A name can not have a copyright attached to it; a copyright only protects original works of authorship. You can apply a trademark to words or phrases, however, by filing a trademark registration with the US government. See uspto.gov for more information.

You can use the poor man's method. Simply type up in general format what you want to copyright and send it to yourself via certified mail.

You can't trademark or copyright your name using MySpace, firstly because a trademark costs money to register with the government, secondly because a name can't be copyrighted.

You can include ™ (google it if you need to) to give you a trademark symbol. However, that's just the symbol and isn't legally binding. If you want a legally binding trademark or copyright you have to go through the courts to do it legally.

A trademark is a unique form of identifying a business or product and is registered with the Patent and Copyright Office. A copyright only covers written words, such as an article, or an image, such as a graphic. It does not cover a specific name.

First search through Trademark Electronic Search System on the United States Patent and Trademark Office. Than identify the goods and service you are providing and decide on copyrighted logos and symbols. Next thing to do is to apply for the trademark and wait for refusal or acceptance.

I have no idea why someone would even consider getting a copyright on a MySpace name, but to each his own. All copyrights are handled by the US Copyright office and trademarks are handled by the US Patent and Trademark Office. Be careful not to infringe upon MySpace's trademark.
