Just saying it is not enough. Make sure you have proof that can be verifiable. This could be friends, families, co-workers or neighbors. Get statements signed by credible witnesses like teachers, priest, police officers. Save any paper trail that can help. And don't ever appear as being vindictive.

You must prove your case with indisputable evidence of neglect and/or abuse. This could be due to alcoholism, drug abuse or psychiatric problems. Call social services for assistance.

If you have REAL PROOF and it's not just you saying this because you hate her, you can call child protective services and tell them you think she is unfit to raise your children. Give them the proof you have that they are not properly being taken care of.

You would have to prove that the mother is harming the child or that the environment he's living in is inadequate for him.

Gather all of the objective information you can -- her work record, the children's school records including absences, hospital and legal records, etc. Then line up some objective (non-family and friend) witnesses. File and present your data to the court; ask for custody and any drug testing you need done.

Regardless of where you live in the U. S. , there are a few basic guidelines to prove either parent unfit. Negligence, abuse, and failure to provide the appropriate environment for the children involved is the proof usually required. Typically, a social worker will need to interview such claims and will report to the courts. However, schools and independent witnesses help too.
