Rotator cuff injuries are particularly challenging to negotiate, for the injured party and the insurer alike. The best advice would be for you to get a written narrative report from your doctor or surgeon aligning the injuries to the accident and ruling out the tear as a prior injury.

You don't negotiate wit your health insurance provider. The treatment of the injury and subsequent repair are either covered, or they're not.

Rotator cuff injuries are among the hardest injuries to negotiate; both for the insurer and claimant. Rarely are both sides completely satisfied. In short, consider getting a narrative from your treating physician that discusses the origin of your injury, the length of treatment you will need, and if you have sustained any permanent injury. This is a good beginning spot.

This kind of injury should not be negotiated by you but by an experiened attorney. He would have sent you to doctor who specializes in your injury to assess the damages. He will then have a better understanding of how serious your injuries now and if it will affect you in the future.
