How do I go about getting out of a living trust?

If it is revocable during your life, you can revoke the trust and remove the assets. Be sure to change title to real property, how your financial accounts are titled, and any transfer-on-death designations leaving assets to the trust. If you have a will that "pours over" assets to your trust, you will need a new will too.

If you have created a living trust and no longer wish it to remain in effect, your attorney can withdraw it. As long as you are competent and in charge of your own affairs, you have the last word. Contact the legal professional who helped you with the living trust paperwork, and request that he pull it.

This is thorny. If it is YOUR trust and there are no trustees, just rip it up. If you are a beneficiary or a trustee, you require an attorney.

You have to look at the terms of the agreement, if it is revocable or not. You would have to revoke the trust in writing or get a court order

If the trust is a revocable living trust, it can be terminated by a document saying so. If the trust is irrevocable, then read the trust to see what conditions (if any) have to occur to terminate it. Check with an attorney who specializes in trusts in your state.
