You compare cases by showing their likenesses to the extent that one case serves as an example or precedent for the next. On the other hand, pointing out the differences in the two cases makes an argument for how the principle of the first does not apply to the second. It's merely an exercise in compare and contrast.

What you are doing is attempting to show the court a precedent. Cases which have gone up on appeal that tend to support your position may be used in court.

This would take a great deal of research. It's good if you can find similar cases, document it, and present it to your attorney. If you are very astute, you can present this to the court, but be aware, even if the outcome of the case is similar, a lot that went on to get there may be very different.
