It depends on the kind of case (criminal or civil) and the matter at hand. Judges (and/or juries) do count on the presentation of sufficient and reasonable evidence to make a decision that is sound. The same evidence, however, in different courts, can have different outcomes. Remember O. J?

"Preponderance of the evidence" does apply in Wisconsin and is typically the burden of proof in civil cases. Although probable cause burden in criminal cases use this standard too.
