Biodegradable items should not be thrown out the car window. It is considered littering. In many areas there are fines for littering. Whether there is a penalty or not, items tossed from a car are unsightly. Biodegradable items do not disappear instantly. They take time to break down and in the meantime, people have to look at the unsightly litter.

Intentionally tossing anything out the car window would be considered littering and could result in a ticket. Plus, biodegradable waste typically takes time to break down, so that banana peel or apple core you throw away will be on the roadside for a while. It's best to take such items home and compost them.

It's probably safe from an environmental standpoint but not legally. It's still littering and you will still be appropriately fined if caught. Even a biodegradable item, a watermelon rind for instance, is a potential danger to fast traffic, is unsightly, may be hurtful to local wildlife if eaten, is non-native, etc.
