Can I sue a tenant that has disabilities?

My tenant has disabilities and is not paying his bills.

Your tenant has an contract with you. You can, depending on the terms of the lease, file to evict him for failure to pay rent. You can of course only act in matters where the delinquency affects you directly.

You can file an eviction case in landlord tenant court. The fact your tenant has disabilities does not excuse the responsibility to pay the agreed upon rent and to pay on time. However, you may have difficulty collecting unpaid rent if the tenant is actually evicted.
