Can I stay in the US after divorcing a citizen?

It depends on your current immigration status. If you have already received your green card or are a citizen, then yes. If your spouse has not yet petitioned for you, then maybe not. However, if you are separating due to abuse, then you may be eligible for a VAWA visa.

I think that illegal immigrants should be able to stay within the United States after divorcing a citizen, they have earned their right to stay and have made a life.

The answer is yes. Divorce does not make you an alien in America's eyes. It is a decision that was made between two people who decided that it will not work out between them.

I am guessing that you are an immigrant who married an American to stay in the country. Once the marriage is determined to be legitimate, you become a citizen. If you divorce them, you are still a citizen, but check with immigration.

Usually that depends on your status at the time of the divorce. Most of the time if you have been married for more than 2 years and you have got your paperwork, you have nothing to worry about.
